These Terms of Use (“Terms”) govern your use of the aitheresa.ai website (the “Site”), which is operated by AI Theresa (“we”, “us”, or “our”). Please read these Terms carefully. By accessing or using the Site, you agree to be bound by them.

These Terms apply to the Site only. Use of the Theresa AI service (“Service”) by customer companies is governed by a separate Master Services Agreement.

1. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts in your jurisdiction to use this Site.

2. Use of the Site

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your personal or internal business purposes.

You agree not to:

• Use the Site in any way that violates applicable law
• Use any automated system (other than standard web browsing) to access or scrape the Site without our written permission
• Attempt to interfere with the operation of the Site or bypass any access controls
• Reproduce, modify, or distribute Site content except as allowed under these Terms
• Use the Site to send unsolicited communications, spam, or malware
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity

We may suspend or terminate your access at any time, without notice, if we believe you have violated these Terms.

3. Intellectual Property

The Site, including all content, software, graphics, text, logos, and “Theresa AI” branding, is owned by AI Theresa or its licensors and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right to use the “Theresa AI” name, logo, or branding except as expressly permitted in writing.

4. Demo Requests and Communications

If you submit information through the demo request form, you authorize us to contact you at the email address you provided. You can opt out of these communications at any time by replying to the email or by writing to contact@aitheresa.ai.

Information you submit through the form is subject to our Privacy Policy.

5. Third-Party Links

The Site may contain links to third-party websites or services that we do not operate. We are not responsible for their content, terms, or privacy practices. Your use of any third-party site is at your own risk.

6. Disclaimers

The Site is provided “as is” and “as available,” without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or secure, or that information on the Site is accurate or complete.

Nothing on the Site constitutes legal, financial, or professional advice. Specific product capabilities described on the Site are subject to the customer’s signed Master Services Agreement.

7. Limitation of Liability

To the fullest extent permitted by law, in no event will AI Theresa, its affiliates, or its licensors be liable for any indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of the Site (including lost profits, lost data, or business interruption), even if we have been advised of the possibility of such damages.

Our total cumulative liability for all claims arising from or relating to your use of the Site will not exceed one hundred U.S. dollars ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

8. Indemnification

You agree to defend, indemnify, and hold harmless AI Theresa and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising from or in any way related to (i) your use of the Site or (ii) your violation of these Terms.

9. Modifications

We may modify these Terms at any time. The updated version will be posted on this page with a revised “Last updated” date. Material changes will take effect 30 days after posting unless you object in writing. Your continued use of the Site after that constitutes acceptance.

10. Governing Law and Disputes

These Terms are governed by the laws of the State of California, USA, without regard to conflict of laws principles. Any dispute arising from these Terms or your use of the Site will be resolved exclusively in the state or federal courts located in San Francisco County, California, and you consent to the personal jurisdiction of those courts.

11. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

12. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AI Theresa regarding your use of the Site, and supersede any prior agreements or understandings.
